Terms of Use

These Terms of Use ("Terms") are an agreement between you and David Elijah Piersaul-Hall ("Boxart," "we," "us"), who operates the Boxart app and boxart.club. By creating an account or using Boxart, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Boxart.

The short version

  • You must be 13 or older.
  • What you post is yours. You let us show it in Boxart.
  • Be decent: no spam, harassment, hate, sexual content or unmarked spoilers. Everyday swearing is fine.
  • You can report and block. We can remove content and accounts that break the rules.
  • Boxart is free and provided as it is.

1. Who can use Boxart

You must be at least 13 years old to use Boxart. If you're under 18, you need permission from a parent or guardian, and they agree to these Terms for you. You can only use Boxart if it's legal for you to do so where you live.

"Your content" means everything you add to Boxart: reviews, Save Points (notes, progress and screenshots), lists, your bio, username and profile photo.

Everyday swearing is fine. Boxart automatically blocks slurs, sexual terms and insults aimed at people from being saved, but the filter isn't perfect, and these rules apply either way.

If you believe something on Boxart infringes your copyright, email support@boxart.club with: your contact details, the work you own, where it appears on Boxart, a statement that you believe in good faith the use isn't authorized, a statement that your notice is accurate and that you're the owner or authorized to act for them, and your physical or electronic signature. We'll remove infringing content and may close the accounts of repeat infringers.

7. Game information and art

Game names, cover art, release dates and other game details come from IGDB. Games, names, logos and artwork belong to their respective owners. Boxart isn't affiliated with, endorsed by or sponsored by IGDB, Twitch or any game publisher or developer. Game information may be incomplete or out of date.

9. Deleting your account

You can delete your account at any time in Profile → Settings → Delete account. This permanently deletes your account and your content, as described in our Privacy Policy. We may suspend or end your access if you break these Terms, if required by law, or if we stop offering Boxart. The sections that by their nature should continue after your account ends (such as 10 to 13) do.

10. Boxart is free and may change

Boxart is currently free. We may add, change or remove features, and we may stop offering Boxart. If we ever plan to charge for something, we'll tell you first, and you won't be charged without agreeing.

11. No warranty

Boxart is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that Boxart will always be available, error-free or secure, or that content (including game information) is accurate.

12. Limitation of liability

To the fullest extent allowed by law, David Elijah Piersaul-Hall won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of Boxart or content posted by others. Our total liability for any claim relating to Boxart is limited to US $50. Some places don't allow these limits, so they may not apply to you.

These Terms are governed by the laws of the State of Tennessee, USA, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Tennessee, and you and we agree to those courts' jurisdiction. Before filing a claim, please email support@boxart.club so we can try to resolve it informally.

14. App Store and Google Play

If you got Boxart from Apple's App Store or Google Play, these Terms are between you and David Elijah Piersaul-Hall, not Apple or Google. Apple and Google aren't responsible for Boxart or its content, and have no obligation to provide support for it. If Boxart fails to meet any warranty that can't be disclaimed, you may notify Apple, and Apple may refund the purchase price (Boxart is free). Apple and Google aren't responsible for any claims relating to Boxart, including product liability, legal compliance or intellectual-property claims. You confirm you're not located in a country subject to a US government embargo and aren't on a US list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Changes to these Terms

We may update these Terms. We'll change the date at the top, and if a change is significant we'll tell you in the app before it takes effect. If you keep using Boxart after that, you accept the new Terms.
